No he is not. Smith can transfer to UGA, he just has to sit out a year per NCAA rules. Smith is asking for a waiver to play this season.

He was refused transfer to another SEC school which is within the rules and other schools do it routinely.
He was granted permission to transfer to Miami.
Threw a temper tantrum (ie "change of heart") when he saw his request for UGA was denied. And refused to clean out his locker and leave the facility.
"If you don't want to go to Miami we can renew your scholarship here at Alabama (which is a pretty kind thing to do). But you're not getting permission to go to UGA."
He refuses Alabama's scholarship renewel. He refuses Miami transfer. So he's basically some random guy using the athletic facility who refuses to leave. Hence "Bro, you're not on scholarship here and chose not to be a part of this team. We can't let you continue to use our facilities."
