Saban has reported multiple instances of his players having illegal contact with agents. We held Andre Smith out of the 2009 Sugar Bowl and suspended Marcell Dareus for 4 games.

Just playing devil's advocate.

Exactly. Saban is not dumb enough to risk his career, reputation, and titles by playing a player he knows is ineligible. Could Fluker have taken some agent money with UA's knowledge? Absolutely. But that sort of thing is not going to get Bama in much trouble.

It does in the punishment phase which is extremely subjective. I'm very aware of the NCAA rulebook and precedent.

The NCAA might need a new rulebook. Hell they claim it is a violation for boosters to go on kids twitter accounts trying to get the kid to go to their school. That only happens 24/7. It is like when you have rules for your toddler. If you aren't going to enforce anything, don't bother.

What is the punishment in Alabama for agents doing that? He was turned in but allowed to walk?

A fine and possibly jail time. University might not have wanted to throw one of their former players in jail. It's bad PR.

If so, they knowingly played an ineligible player.

Doubtful due to precedent. But keep reaching.

I'm not sure about that. While unknowingly playing an ineligible player doesn't result in future penalties, I don't think it helps any with not having to vacate a win. Alabama compliance literally did everythig correctly and was heavily praised by the NCAA in the textbook case but the fact that the players involved played several games after breaking rules we had to vacate wins. Not knowing they were ineligible kept us from gettin future penalties hut didn't help with the vacating of wins.

I believe the NCAA also said the people in charge of the exchange should have known what was on the up and up and that's why we were forced to vacate all of our wins.

Yep. Compliance was praised for self reporting and cooperating, but Bama was hit hard on textbooks because we should have known something was up with so many players checking out extra books, yet it went on for several years under Shula until Saban found the problem and fixed it.

I hate Alabama as much or more than anyone but I have no problem with DJ Fluker or Mark Barron getting a little spending money advance on their NFL signing bonus.

this is the same thing that happened with reggie bush(albeit more money) yet everybody is so quick to peg SC as cheaters and deserving of losing their bcs championship.

I've got a very close friend who's brother works in the compliance department(i know, i know). He said that they have had quite a few off the record conversations with the NCAA about this well before the story leaked. NCAA has already cleared Bama.

"Yep, if the NCAA doesn't pursue this, they are done as a regulatory agency. Open season for cash flying errwhere. If they want to investigate something in the future, I'd tell them to go frick themselves."

No it isn't, at USC a coach knew about it and tried to cover it up, big difference.
