OPELIKA, Alabama -- Accused Toomer's Oaks poisoner Harvey Updyke surrendered to the Lee County Sheriff's Department on Thursday to undergo additional psychiatric evaluation at the Taylor-Hardin Secure Medical Facility in Tuscaloosa.
A motion to revoke Updyke's bond based on his Sept. 19 arrest in Hammond, La., for terrorizing is being held in abeyance until Taylor-Hardin completes its evaluation of Updyke.
Updyke's latest psychiatric evaluation will likely result in a continuance and move his trial out of the criminal term beginning Oct. 1. Updyke has been charged with criminal mischief, desecration of a venerated object and damage to a crop facility for the poisoning of the historic Toomer's Oaks in Auburn.

OPELIKA, Ala. -- A judge has revoked the bond of a University of Alabama fan charged with poisoning Auburn University's landmark oak trees in a fit of football rivalry.
Harvey Updyke was taken into custody following a brief court hearing Thursday in Lee County.
Circuit Judge Jacob A. Walker III revoked Updyke's bond because he was arrested earlier this month after a dispute in a Louisiana store. The judge then scheduled a hearing later Thursday on whether the revocation will stand.
Updyke faces trial next month on charges of poisoning the Auburn trees. He recently got two new defense lawyers.
Defense lawyer Margaret Brown told Walker the lawyers had not had time to review the tree case. She said they will file several motions soon about the location and timing of the trial.

It's just dumbass auburn fans mad cause he ended their retarded tradition,don't let em get to ya.
If their teams had a quarter of the success Bama has had on the football field,they'd have the same type fans,it comes with the territory.

They aren't getting to me, takes a lot more than words on a internet message board to do that.
I have just seen fans of other schools say that just b/c so and so didn't go to Alabama and yet pull for them, they are all of a sudden a drunk, retarded, frick-up who poisons trees.

I couldn't care less about Harvey Updyke. At first I was kind of pissed off when he poisoned your trees, now it makes me smile to see how much he pisses you guys off.
