All this story has created was a new liar.

Either her or him.

We may never know who.

Yep.

Such a thorny issue because you want to treat the accuser fairly in case her story is true, but then when they turn out to not be true, the damage to the accused is already done.

Also thorny because in lots of these cases, the victim is not willing to press charges because of a perceived threat. DGB got kicked off the team anyways even though the victim didn't want to press charges because of pressure from DGB's girlfriend and blow back she would get from Mizzou fans. Pinkel and the AD had the responsibility of acting upon what they knew, instead of pretending that the legal system runs the football program.

Absolutely, and should have included that in my post. I had a very close friend in college that was raped and she refused to report it because she didn't want the humiliation of re-living it over and over again to police, lawyers, judges, juries, etc.

If she truly made it up she should be prosecuted. I hope this story isn't over.

Tell me he's reinstated for tomorrow?

You would have to think that the school and the accuser were able to come to an agreement on a settlement early enough.

but in real life being accused of rape is a difficult accusation to overcome. Perhaps he will since this case is so public, but there will be some that will always associate him with it.

So someone making a false allegation against you is really hard to overcome? Cry me a river.

If there is reason to believe this was a malicious attempt on her part, I imagine she will be charged with something. There was a girl who claimed to be raped in 2012 near Weimer, and when it came out that she made the whole thing up for attention essentially, she was charged.

LINK

Obviously this is a delicate issue where on the one hand you don't want to create an environment where real victims are afraid of being punished if they don't win the criminal case but punishment without even a trial is clearly wrong as well. And I think serving both of those interests is really hard if we're all honest about it. I'm glad it's not my decision to decide how to handle a rape allegation. However, wherever the line is between a misunderstanding and mendaciousness, if the authorities feel she crossed it, she will be charged. And if she is, then you'll know who the liar more than likely is.

Certain allegations, yes. Rape is one of those where you're almost guilty until proven innocent.

Not necessarily. There are shades of grey in certain cases, and then there is the fact that you are frequently dealing with folks whose faculties were impaired by alcohol or drugs.

If the girl withdraw the charges on her own volition, and there's no evidence that she original brought the charges maliciously, then everyone should probably just let the matter drop and move on.
