SMU had been put on relatively mild probation in the early 80s, and kept on truckin', cheating-wise.

The reason I am chiming in is that the proof that ultimately got SMU the death penalty was uncovered by WFAA Channel 8 in Dallas, and specifically, Dale Hansen - you might know him, he is NOT a Texas fan by any stretch of the imagination. He's a MotherShucker (Nebraska).

A linebacker named David Stanley had the paper trail and laid it out for Ch. 8. Then Ch. 8 got the SMU admins, coach and some trustees in a room together and confronted them with the evidence that they had not slowed down their slush fund - which was overseen by the Texas Governor, Bill Clements, an SMU alum.

The video of Hansen throwing the proof on the table was something else (I can't find it online). They all looked like they had just been served a shite sandwich. It was classic "gotcha" journalism.

The presumption applies only in criminal cases. Manziel isn't charged with a crime, thus there is no legal presumption of innocence involved. Individuals certainly are under no requirement with respect to forming opinions about guilt or innocence to wait on formal, legal proofs of guilt. Outside of the legal system or "quasi-legal" processes, people rarely operate on this principle.

In my opinion, he is probably guilty. If he were innocent, it would be a simple matter for the autograph dealer to say, "I didn't pay him any money, end of story." But the silence or refusal to talk is telling. Honorable people with knowledge of the facts wouldn't let an innocent man drown in a sea of innuendo and character assassination. The silence might not be proof for legal purposes, or even for the NCAA, but the implication remains pretty strong.

At this point, unless one of the dealers talks to the NCAA, nothing is likely to happen. But that doesn't mean I have to think he is innocent of breaking the rules when things don't seem to pass the smell test.

I hope he isn't guilty. That would be the simplest and best solution. My common sense says that he probably is guilty. But unless or until there is some actual evidence (like confirmation by a dealer), I won't quarrel with a decision to let him play.
