What if it was parking lot where he was drinking?

He'll likely plead it down to a reckless driving IMO

Maybe we are. The law doesn't require driving, only "actual physical control." Also, unless he was accompanied by companion(s), it may be reasonable to infer that he had driven the car to the location of his arrest.

he had to drive to where he was parked, didnt he?
He probably parked it there earlier in the night before he started drinking.

I just know that if that were me and I got too drunk at a bar and everything was closed I might be forced to sleep in my car. That sure is a better idea, to me, than driving. If that were the case, then I salute Mr. Hand for actually being responsible.
But the flip side of that is, he could have very well been driving and pulled over and then passed out.
Yep, I've had friends do both. No telling what happened with Hand so it's kind of dumb to speculate

Before getting hammered maybe. The Strip bar scene is all walking distance. Park, bar hop, eat, return to car.

He may be ok if he was in backseat. I know I'd be pissed if I was sleeping in backseat and had car running for ac and got a dui
You may be pissed but you would also be thankful because it might had just saved your life. Many people have died sleeping in a car that was running because they had the heat or A/C on.

Right. Have any of y'all never driven to a bar to then do heavy drinking before?

Maybe the car a/c wasn't working?

Why would that be reasonable? Late at night in Tuscaloosa, you are never more than 5 minutes from home.

You do remember the Cam Robinson story, right? If the charges were dropped on that then this is a walk in the park.

I think you read an article from last year.

It was cold that night. I'm sure he just had it cranked so he could turn on the heater. The lights were on because he had a hard time finding the heater on switch, he left his glasses in the Library .

not worried at all...the REC has this covered. #9 will have 3 sacks against FSU

It is a DUI, but something he may be able to get out of (or reduced to something lesser) with the right lawyer.
Props to the kid for not driving though.
