What if you stopped the car and got in the passenger's seat or the back seat, is that still a DUI?

Looks like another batch of millennials have learned the law about possession of the vehicle, reasonable intent to drive and DWI.
I must say, though, that I applaud the Alabama fans who aren't trying to use this as a way out.
Edit: Sorry, Tuscaloosa, I think I was referring to TT9.

Just made a bad choice, it happens
Just because a law technicality says it is illegal, doesnt mean the decision was poor.

He'll likely plead it down to a reckless driving IMO

quote:Well, it's damn hot in Alabama. You have to crank the car to use the air conditioner.
according to Tide Sports, car was running

The choice of how you get home or who drives your car should be done before the drinking begins, and not when you are drunk.
You seldom make good choices while drunk. It's unfortunate for Hand, but I doubt this will hurt him from getting employed in the NFL. I also doubt it will stop him from playing in the game.
I would be interested to know if he was drinking on campus or had already been driving back from a bar/club and decided to pull over to sleep it off?

None of this news matters. He won't miss time and never was.

If he turned the A.C. on and tried to sleep it off, then I have no problem with what he did.

I read somewhere the he had a hit and run earlier that night?

Same thing happened with UGA last year.
quote:
According to police, Ledbetter was found literally sleeping at the wheel of his car, which was still running, and blocking traffic at a stoplight. The police parked a car in front of Ledbetter's car to keep it from rolling into oncoming traffic because the car was still in drive with Ledbetter's foot resting on the brake.

So go hide your keys somewhere. Then go to sleep
Mind. Blown.

This does not mean the arrest was unwarranted. Aaron Suttles reports: “According to Alabama state law, Hand was deemed to be in ‘constructive possession’ of the vehicle, and although he wasn’t driving and the vehicle was parked, the keys being in the car was the determinant that triggered the arrest.”
Good call. Let's punish people for actively trying to not drink and drive

Same thing happened with UGA last year. Lets see how different this case is handled.
Georgia DL found asleep at wheel during DUI arrest, facing two-game suspension
Very different circumstances, agree? Hand was in a parking lot and the UGA guy was blocking an intersection. I would assume the punishments will be as different as each situation.

Highly doubt it was this.

Which it appears it wasnt. This is BS. Hand is being persecuted.

Hand was parked in a near-campus parking lot, sitting in the driver’s seat with the headlights on and the vehicle cranked, but was asleep with the car in park.

He should have played things safe and just had a stolen gun and dope in the car.

quote:That's what I was wondering. If so, the DUI is warranted. If not, and he literally walked from the bar to his car and went to sleep with the keys in the ignition, it's not a big deal.

Either way, there's no suspension coming his way.

Who the hell turns on their headlights to go to sleep in their car while drunk? (Unless they were intending to leave.)
