Yep im sure no plaintiff lawyer wanted this case at all.

What does that have to do with anything? Of course people would jump on the case. It is gonna pay out...not the mega-bucks people are talking about though.

How is that germane? You pointing out discriminatory or institutionalized harrasing conduct by an employer toward an employee and getting a settlement =/= getting a ruling in your favor on an IIED case against a party who did not perform the outrageous behavior.

A couple of things:

1) I did not throw out that figure.

2) I'm going to step away and defer to you, Justice Scalia.

I agree with everything you just said. Dude was almost a big DA as Downing. However people who think the case has a low value are insane.

I just don't think it will be hard to get a jury to believe the employees were neglegent in some way.

I don't personally believe Krystal should be held financially responsible but they will be. Because it's sexual in nature the payoff will be bigger than some case where a customer slips on a wet floor.

Can the NCAA sanction Bama for losing institutional control of it's fans? One guy poisons a couple of trees and another guy drags his nuts across the face of a young opposing fan.

Probably. I imagine the defense will paint the plaintiff as a public drunk and try to dig up dirt. Wonder if they'll find records of him posting here. How screwed up would it be if he was found to and was found to have posted taunts to teabag opposing fans at Tiger Stadium. Or even worse, was one of those that was calling a 13 yo girl a whore for being forced to give a bj to a Louisiana recruit a year or two ago.

Having said all that, I'm ignorant as to civil suits and litigation and if that would even be admissable in court. This will be settled by all parties. He'll have the continued embarrassment, the teabagger will also and the lawyers will walk away with the majority of the money.

You forgot the forced sodomy committed on 1/9. Atrocious conduct and, frankly, hard to watch.

I don't think it will see a courtroom either because Krystal will not want to take a chance on letting the kid's lawyer drag his/her legal nuts across the corporation's face.

I bet they'd pay 6 figures. That's only 10 Krystal Burger employees' yearly salaries.

We shall see.

I dont think anyone reasonably thinks this will go before a jury. But the settlement value to the solvent defendants is way higher than 20k.

You fail to realize that this is not an IIED case, its a sexual battery case, Justice Ginsberg.

I think they'll settle, sign a non-disclosure, and we'll never know what he got.

If I was a betting man, I'd say 30-40k though. Dude walks away with 15-20k.

I think a fitting punishment would be to ban your female cheerleaders and make you guys "TAMU" it for a year. That should teach you fans to get out of control.
