the pair of players had been shooting guns at a range earlier that night but did not take them home.
So I found this

When approaching the vehicle, officers spotted a handgun on the lap of the passenger. A bag of marijuana was also observed on the driver's side floorboard. The stolen handgun was located under Robinson's seat.
Why was the gun on his lap? if the guns were just still in the car because of the range, I dont think your lap while smoking pot sounds very reasonable

How these two haven't been kicked off the team is beyond me.

but he didn't commit a crime by buying a gun he had no reason to suspect was stolen.
Yes he did. Required or not, that's why you get a bill of sale or call the serial number in to the ATF.
quote:
that is a legal defense in these cases
It's an affirmative defense. That word affirmative is a big deal, it means Cam has to prove he didn't know it was stolen, not the DA. If getting out of this charge was as easy as just saying you didn't know it was stolen then the charge would never stick.
quote:
Cam's charge will be reduced or dismissed
It will be reduced, as a part of a plea deal. I said that like four posts ago. It's because he's a first time offender, and he definitely won't try to fight it. If he does try to fight this, and ends up pissing off the DA, they have him nailed on the felony unless he can produce paperwork showing he paid a reasonable price for the gun. I'll let you ponder whether or not you think he has that.

You've never gotten blazed and cleaned your gun after a trip to the range?

What, you don't store your range weapons on your lap on the way to smoke some weed in a park? You need to live a little man.

Nothing to see here. Plenty of cash exchanging hands. Two innocent children. Move along ......

So do are we gonna have another 60+ page thread discussing the exact same scenarios we were discussing a few weeks ago (except for saying they were at a shooting range earlier in the day which doesn't really matter at all)

No he didn't.
It is absolutely not required to have a bill of sale nor a background check or anything else on a person to person weapon sale in the state of Alabama.

If he knew it was stolen, I'm sure he would just say so.
But don't worry, no one expected Saban to actually punish someone he needed to win.

Has Cam or Hootie mentioned anything publicly?

In all seriousness, the owner of the local West Monroe gun range had a solid day sometime in the last couple weeks. Great margins on free money. Good for him.

Correct, but it's a felony in LA to be in possession of a stolen handgun. You can defend yourself against that charge in several ways, but you will still be charged with the crime. Getting a bill of sale is your best way as a buyer to protect yourself, even though it's not required by law. This isn't rocket surgery.

Not stolen if you buy it from someone
Stolen property is stolen property. If someone sells a stolen item to an unwitting buyer (which may be the case here) that doesn't mean the gun isn't stolen.
Now I haven't looked at LA criminal statutes, but the key element is probably knowingly possessing a stolen firearm. If he bought the gun legitimately, then he can't be convicted of that but he doesn't get to keep the gun because it is still stolen property.

Exactly, it will be return to it's rightful owner the that person is out the money he paid for the weapon.

Pretty certain, that's only the case if you actually stole the gun or knew of who stole the gun.
