Yeah that portion of the monies does seem crazy, the tree replacement value seems very much inline. My guess is, its not all just testing, but also containment, removal, disposal, and replacement of the soil. Possibly even the trying to save the trees, not sure if thatst in the auburn cost though. Government contracts do get max rates, but that is crazy if just testing.

I am sure that all of that is included in the total estimate and it should. ALDOT makes you haul any materials to approved sites on all their jobs. This isn't just tainted materials, this is all materials being removed from the jobsite. Imagine what ADEM would require these days for all of the actual bad soil. Hell, they are stupid enough to possibly make you haul it to Oregon or China.

I have said all along that Updyke shouldn't be in jail but he should have to pay every dime that is spent on getting the corner taken care of and now the DA is taking that approach.

Updyke was wrong no doubt. However there is no way in hell they spend that much money on already near dead trees. If they did,it only shows their ignorance over some old trees. frick the toilet paper tradition. Trying to milk it,though IMO they won't ever get that out of him lol. Bull shite

His legal team did this probono. To garner attention. How else do you afford or get appointed the same guy who defends politicians. As far as the amount, of course not, but it's restitution, doesn't mean he will ever repay it. Like most major tax offenders he will live off the grid, cash only, from a friend. But only if he is lucky. However he will be ducking and hiding from his dumbassery for the remainder of his life. As an ex Leo. He should know better and add to that he has multiple charges of similar dumbassery, I don't feel any pity for the man

This is more wasted money trying to get blood from a turnip.

IMO this is just more PR pity because they know he doesn't have any money.

He saved a ton of trees in the process, he should be applauded.. Updyke is environmentally friendly. Al should have him at his next going green outing.

All trees have a life cycle. There is a reason trees are harvested in a cycle. That doesn't mean that it isn't a illegal to go dump a bunch of chemicals in the middle of town to kill them because you are a insane psychopath with severe mental issues.

I'm sick of people making excuses for and forgiving shite like this. How about we let him pay for the damage he caused or go bankrupt and never have a dime to his name again trying to pay for it? If you frick up, you should have to pay for it, simple as that.

Just saying I feel like their time could be spent in much better ways than bringing this case against him when he will clearly only be able to pay a very small fraction of whatever the settlement ends up being.

Good for the DA. While Harvey is serving a minimal jail sentence, like he should in my rational opinion, at least this way it assures that the stupid frick lives off food stamps the rest of his pathetic life. AU knows they'll never see the money...just making sure he suffers the rest of his pathetic life. Kudos...well done AU, well done.
