Because we have a nation of police officers who think that they themselves are the law instead of those who enforce it. Because Americans are consistently subjected to the hero worship of police by both our mass media and politicians. Because most Americans are more than willing to accept a creeping police state, either because they feel safer or because they're too concerned with mindless reality television to give a damn.

It is illegal for police to do this. But DAs typically give very wide latitude to police when charging them with crimes. It is what it is (until we change it).
