LITTLE ROCK, Ark. (AP) - The Arkansas Supreme Court has rejected the state attorney general's request for a stay of a judge's ruling that overturned Arkansas' constitutional ban on gay marriage.

The high court on Wednesday turned down the request from Attorney General Dustin McDaniel that would have halted the issuance of same-sex marriage licenses.

Pulaski County Circuit Judge Chris Piazza had ruled last week that a voter-approved gay marriage ban was unconstitutional, but didn't issue a stay. A few counties began issuing marriage licenses, and by midweek about 450 couples had gotten them.

The vast majority of the state's counties refused to grant licenses, saying the Supreme Court needed to weigh in. McDaniel said a stay was necessary because clerks did not know whether they were obligated to issue licenses.

The Arkansas Supreme Court has declined to issue a stay on a circuit judge's ruling last week that found the state's ban on gay marriages unconstitutional, but its opinion indicates that ruling does not give county clerks the authority to issue same-sex marriage licenses.

In the opinion released early Wednesday evening, the court said the ruling did not address an Arkansas law that prohibits a marriage license being "issued to persons of the same sex."

"Therefore, the circuit court's order has no effect on ... its prohibition against circuit and county clerks issuing same-sex marriage licenses," the opinion said.

Sounds about right, i don't really agree with the ruling either, it should only be overturned by the supreme court.


Regardless, people are going about it backwards IMO. Why not eliminate government entirely from marriage. Problem solved, instantly. But we can't make the government smaller now can we, even if it provides us the freedom people are asking for. It's illogical.

I agree in general, though I'm not sure you and I agree on the details.

I think the government should issue civil unions only, and that civil unions should be equally available to opposite sex and same sex couples.

Marriages can be handled by whatever spiritual groups a couple chooses, and those spiritual groups should be free to decide which couples they are willing to marry.

So, the state really had nothing to appeal? Is this what I'm reading in that?

So, are all the marriage licenses null?
