Now that he's under sentence, he qualifies for good time. We're talking somewhere in the neighborhood of 55 days to serve. His lawyer did a good job and that DA blew it. The DA will say "3 years" but he's going to serve about 2 months. Sad state of affairs.
By way of comparison, you can, and people often actually do, get considerably more than that if you have priors and you drive on a suspended license.

I think you are a lawyer, so you know what I'm saying when I say that with a high profile case, you have to really get a good result or you will get scrutinized. So while you have a point, it could do damage if he violates the parole that his initial sentence was so light.

ith a high profile case, you have to really get a good result or you will get scrutinized.
He should be punished for his crime and not for the magnification of the crime do to a football rivalry. I think the sentence is fair, but I realize there are very reasonable opinions that are different from mine.

I don't think he is eligible for the Correctional Incentive Time Act. He'll get credit for the days he did, and serve out the remainder of the 6 months...and then do the rest on paper/probation.

I think you can get a good result and not necessarily treat it differently, though. DA's know that when the world is watching, you have to play some serious ball.

LOL All this wasted time and AU butthurt, and all Updyke gets is basically 55 more days in jail.
