You're trying to argue that if they put a some titties in a video game that it wouldn't receive a sexually explicit content label on it. Or if Kayne West came out with a new music video showing some titties there would be no sexually explicit content warning on it.
No need for parental overview for little Johnny on picking up the new Xbox One game. It only shows some titties in it.

I am questioning if the law may define sexually explicit differently than what a movie or a video game may define it as due to regulations set on them.
Does the FTC create definition for the laws of states in these types of cases?
I think you are confusing what is defined for movies, games, etc with how the law defines it as. I don't think the two are one of the same. I could be wrong, but I don't believe just showing her titties would be described as sexually explicit under the law. I don't know but that is how I see it based on the definition I found from that law website vs the FTC.

In the age of serial rapists being drafted first overall, taking a few pics of a skank isn't the worst thing in the world.

She called the police and claimed rape. They are charged because of the pictures. So where's the fricking?
Did she lie? Was she charged for lying? Is all that happened photos? Why not say something to them before phoning cops.
I personally thinks she did something she regretted or she claimed raped just to get the photos from making the rounds.
My defense.....prove she was drunk or frick off. She came over, got naked, and was letting us take pics of her.
Unless there was sex...But they didn't have other charges. Wierd shite, why isn't her credibility hurt by lying.

She was so drunk she passed out several times. Woke up to flashes and went back to sleep. If all these sick F's did was take photos then this young lady had someone watching her back.
Maybe these golfers just wanted photos of a naked girl to show the other scholar athletes they can get some also.
But if it was only photos that young lady was very lucky !!!
