nothing, or do you mean carrying a concealed weapon without a permit?
yea that
he owns the gun but he didn't have a concealed carry for it

So, I see now that the gun was under his seat of his car. He wasn't carrying it. He didn't do anything wrong. If Alabama wants to have liberal commie gun control laws that's their problem. Williams is from Louisiana where the Constitution over rules the state law

It was likely planted by LSU friendly cops... Black Lives Matter is assembling in Tuscaloosa as we speak.

generally speaking, it's a class C misdemeanor in TN, $500 fine or a class A if it was in an area open to the public
For convicted felons or when used in the commission of a violent crime, it's a Class E felony
If it's the misdemeanor, it's very easy to get an under advisement plea for someone without a record. Had a client who forgot her gun was in her purse and carried it to the fricking airport Negotiated that plea for her

Open or concealed? Either way y'all have some stupid gun laws.

so what's the penalty for owning a gun but not having a permit on it?
Absent any other issue, at worst a small fine. In all likelihood it will be dismissed with a "don't get in trouble for a year" warning.
With no additional charge, it is a very minor offense.

so, okay
so if he's not a felon then basically he's going to be fined for not filling out paper work? Does he lose the gun?
I know nothing of guns

If it were his gun, and he wasn't charged with anything else, I don't have a big problem with it. He was probably pulled over and got the third degree from Barney Fife, and asked do you have a weapon and he told them yes.
After that I am sure he and the vehicle were searched and nothing was found, and he was not intoxicated. No big deal.

Doesn't matter if it is in your car (and within reach) you've got to have a permit.
And yes, it is a stupid law. The legislature has introduced bills to match our surrounding states for years but they die because the Sheriff's association fights them. The revenue from pistol permits go to the county sheriff - and many make hundreds of thousands of dollars a year off them. Most of that would dry up if you didn't need a permit to carry in your vehicle and the sheriff's know it.

its getting better. We changed up a LOT of laws a couple years ago and next year looks to hold some more changes, for the better. We are actually a lot better than most states but admittedly, Louisiana has some of the best gun laws in the country. Next year as have a law coming up for vote that should put us in good shape.

Cop smelled weed, searched car, found bag of weed in center console and gun under drivers seat

yeah, they are our biggest problem. I dont think they will be able to do much next year though when Constitutional Carry goes through, which I expect it to easily

yeah but the other guy in the car claimed the weed so its a non factor for Tim

so basically any random act of violence could be cured by less strict gun laws?
The robbery in Nashville absolutely could have been prevented if the victim had a gun.

Agreed, but does not coincide with barners theory

you'll likely have the gun involved in the offense confiscated but won't lose your right to carry. You lose your right to carry if you have been convicted of domestic assault, stalking, a felony, have a standing Order of Protection, have 2 or more DUIs in the last 10 years, have been adjudicated mentally defective, have been dishonorably discharged from the military, or an illegal alien

Pretty much. Alabama isn't a pure "shall issue" state. A sheriff can deny a permit. If you're denied a permit you can appeal to a circuit judge and if the sheriff can't articulate a valid reason he must issue it to you.
The permit costs at most $20 a year. Fill out the form, pay the money, and (assuming you pass the background check) you're good to go.
Probably won't get it back until the case is over but I doubt he loses the gun. Just depends on the judge.

Not having a gun certainly didn't save him.
