It will never go to court. The victim will go back to her home town, somewhere near Oxfird, and Hoover PD won't go that far to arrest someone for a minor charge. The warrant won't be signed by a judge until Monday at the earliest.


And is Vandy whistler going to come back for court from Nashville anyway?

I remember the first time I saw birdman. I had heard him for years, and I always pictured him being a quaint little guy with glasses and maybe a bird watchers round brim khaki hat. One idle mid week game, I had taken my little one to the park and was sitting behind home in the third base corner. There were a couple of old timers sitting behind me, and another came down the aisle heckling at one of the men being in his seat. That man was a early 50s, normal looking longer haired man with a faint beard. He leaned back in his seat and let out a distinct whistle..

I almost turned around and shook his hand, but I didn't... want to have charges pressed on me

As to civil liability for a battery, the touching must be harmful (meaning physical pain or injury) or at least offensive to a person's reasonable sense of dignity. If the tap did not cause pain and would not be regarded as offensive by a reasonable person, there is no battery. In the civil context, the correct term for an intentional harmful or offensive touching is "battery," not "assault."
