It really depends on the nature of the information that is being reviewed. In this case, there is little information that is subject to privilege. There are no emails, text messages to review. There are student phone numbers and that should not be difficult to identify. The lawyers will not likely be looking up phone numbers themselves unless they are looking to pad their hours. They aren't claiming privilege for anything else apparently. It is unlikely that they could. Even the student phone numbers may not be privileged.
FERPA doesn't necessarily preclude all student information from being released. If student numbers are in a published student directory, that is not generally private. Whether phone records of a call are part of the student record is the question there.
