Au is not charging him with anything. The DA is charging him on behalf of the state.

I know, sorry for my phrasing. AU is the victim here and they can only tell the DA if they approve of a plea deal. They`re obviously going to let this drag out a bit so I`m assuming they want jail time. IMO he deserves it bc he`s still ignorant and believes football is the only thing that matters.

Bama and LSU fans need to recognize that fact. They want to keep giving us hell for things that we are not doing and have no control over.

I don't understand how you got that fricking idea, but if you want to frick with the EPA, go ahead. I'll be more than happy to see my tax dollars keeping your coonass incarcerated in one of the Federal Prisons that isn't designed for white-collar criminals.

How will he pay a huge fine when he has been listed on the court document as an " indigent criminal client."

I hope they give him 10 years just for being a dumb redneck who named his kids that.

Serve more jail time? Can't get blood from a turnip/indigent can you?

Looks like AU will end up getting nothing of monetary value from Updyke since he has nothing to get. I think we'll all feel better knowing his crazy arse if off the streets though.

Given his self professed medical conditions, I doubt he ever sees daylight as a free man if he gets more than 3-5 years.

I do hope that the presiding judge during his sentencing hearing (provided he is found guilty or enters a plea of guilt) will enable garnishment of his pension to assist in covering the cost of his incarceration.

SIAP, but no federal charges for Updyke.

LINK

He has been indicted by the grand jury.
quote:

Wednesday morning, the Opelika-Auburn News has reported that the story whose genesis was apparently on the Birmingham television station has been determined to be incorrect. Instead, the News writes, “a Lee County (Ala.) grand jury has indicted the Alabama fan accused of poisoning the Toomer’s Oaks sometime after the 2010 Iron Bowl on multiple charges, including criminal mischief and the desecration of a venerated object.”

According to court documents, the grand jury indicted Harvey Updyke Jr. on two counts of first-degree criminal mischief, a felony charge; two counts of desecrating a venerated object, a misdemeanor charge; and two counts of unlawful damage, vandalism or theft of property from a farm animal or crop facility, a felony charge.

An arraignment has been scheduled for May 26, with a tentative trial date of June 20. And then, hopefully, within a week or so we’ll never again have to type the name “Harvey Updyke”.

Kinda like Auburn fans have given Alabama fans hell over the actions of ONE lunatic? A lunatic that the Bama fanbase had no control over but is now the result of Bama fans' negligence according to Auburn fans?

Armed robbery by 4 players = no jail time

Poisoning a couple of trees = 5 to 10 years in the pen.

We have now entered bizarro world in this country.
