They wouldn't say. They also wouldn't say who else might be charged or even indicate in one direction or the other. They did say the whole thing was revealed by happenstance -- one person was reviewing dorm video due to an unrelated event and what they saw the players doing in the hallway was enough for them alert VPD. I assume that person would've been a Vandy official associated with security or even VPD since they were reviewing dorm tape to begin with.

IIRC, the two counts of sexual battery come from what was recorded in the hallway by the security cams but I could be wrong about that.

Maybe a dumb question, but what is the difference between sexual battery and aggravated rape? They are charged with both, right?

You mean Eric and there was another website (Gawker or some place like that) that said they'd been given the same info. Today MPD spokesman was asked about it and described her as good friends with one of them.

If it proves to be a clear-cut rape case then I have no sympathy for them but if they were all drunk/high/passsed out or whatever she kind of put herself in that position too. I'd say 90% of all sexual encounters in college involves alcohol. Sometimes women scream rape as a weapon.

Yes they're charged with both. Sexual battery is a catch all for unwanted sexual contact when certain elements are met. It can be anything from compelling another person who is unable to consent to perform an act to a number of different things. With so little out there it's hard to even speculate what specifically they did but the fact that she was unconscious/unable to consent to any contact would qualify unwanted sexual contact as sexual battery.

Why wouldn't they say? Was she like totally unconscious or drunk/semi-unconscious? If a man and woman get equally drunk, and have sex, who raped who? If the man is not drunk as the woman, it's rape obviously. BUT if both parties are equally intoxicated, is it a rape?

No problem SL. It's a disturbing case all the way around and I wonder what in the world that one official saw on the hallway dorm tape that sent them directly to VPD.

Do you think that the fact that the investigation is still ongoing may have something to do with it, dumbass.

If a woman is unconscious and 4 guys have sex with her, it is fricking gang rape you piece of shite. You really should just stop. You are showing us all how trashy you are. I hope you don't ever have a daughter. You will probably pimp her out.

The cases of women who use it as a weapon are extremely rare. The Grand Jury wouldn't have returned this indictment if they weren't very sure. The girl was passed out, unconscious. There is no way she could have consented. I don't care of they were drunk of not - an unconscious woman cannot have consensual sex.

Throw the book at 'em.

The MPD representative said he couldn't comment on that. He was asked if it was alcohol, or if she was given something, and he said he couldn't comment. Probably because the investigation is still going on, and he also didn't want to give out too many details out of respect for the victim. He said the details were too graphic.
