Rosebowl has apparently confirmed what I've been trying to tell you idiots.....outside legal counsel is not subject to FOIA laws.

Rosebowl probably has no clue how to get information via the FOIA.

Your reply doesn't really pertain to my question. The point is that if this information belongs to the NCAA, but was revealed to OM, then it doesn't matter that OM is a public university because they don't actually own that information.

Which is why they sent him all kinds of shite they have in their compliance office, but not the letter from the NCAA.

Just because the information was shared when it was sent to OM doesn't mean it's owned by the university.

Rosebowl is Steve Robertson. He's the Scout.com guy for MSU.

The fact that I work for a government agency and collect information to respond to FOIA requests on a regular basis. You cannot use outside counsel to shield the information. We often use them to review docs for privilege but In end you have to turn them over.

NYC probably nailed the reason they are withholding it for now - the issue hasn't been resolved and OM may still be investigating the allegations. They are probably on solid ground there at least until their window to reply has passed.

Just so we are clear...you are, in fact, saying that a letter addressed to outside counsel is subject to FOIA?

Also...their window to reply was today.

The ole miss AD should show the NOA, I mean really, they should have had it for awhile now.

That way the black bears would know if it is 1,4,5,13,28,47 allegations against them in football.

Regardless, Bjork should be fired since he was in charge for hiring the track and wbb coaches and oversaw their (bad) cheating. Really, who cheats in track? and are the black bears even relevant after cheating in track?

I find it amusing that ole miss fans look to a State source for information about their program, since their own athletic department lies to them.

Man there must be some bad shite in that letter if they are going this far to refuse to share it. I bet it tells who killed Kennedy.

"Nah brah, letter was sent for outside concel, and our university doesn't believe in copy machines."

Stop saying black bears.

It's dumb.

I'm glad you find that amusing. I also find that idea to be amusing as no ole miss fan has gotten their information is rosebowl.

The fact that the letter went to the representative of the university has no bearing on whether or not it is subject. They are a contract employee of the school. The letter belongs to the school, not the lawyer.

The window to respond I was talking about is the window to respond to the NCAA, not any FOIA request. They can probably make a legit claim that releasing the letter now will impede their ability to investigate the accusations and respond to them.

A university official would have been forwarded all the documents in addition to the outside counsel. They're just giving Steve a hard time.

JustGetitright is correct about FOIA.

The only holdup here, I posit, is an exemption under FOIA for "ongoing investigation."

So what I'm gathering is all the random shite sent to Rosebowl, those are addictional infractions on top of the shite in the NOA.
