It is his name--both legally and practically speaking. That some unidentified TAMU fan conjured this thing up a couple years ago is of no consequence.

Johnny Manziel is Johnny Football. Johnny Football is a term used exclusively in reference to Johnny Manziel. Without Manziel, there is no Johnny Football. When people purchase bootlegger products with some type of JFF reference, they're buying it specifically because people associate it directly with Johnny Manziel.

Quit trying to convince yourself Johnny Football doesn't belong to Johnny Manziel because of the nominal fact that it was someone else who gave him the name.

Also

quote:

According to NCAA bylaw 12.5.2.2, “If a student-athlete’s name or picture appears on commercial items (e.g., T-shirts, sweatshirts, serving trays, playing cards, posters) or is used to promote a commercial product sold by an individual or agency without the student-athlete’s knowledge or permission, the student-athlete (or the institution acting on behalf of the student-athlete) is required to take steps to stop such an activity in order to retain his or her eligibility for intercollegiate athletics.”

The nickname and who came up with it is irrelevant. The problem here is not that the douche is selling " Johnny Football" generic merch, it's that he's selling shirts that clearly are supposed to represent "Johnny Manziel, Texas A&M quarterback and Heisman trophy winner"

The fact that it doesn't use his name is meaningless.

If I were him, I'd trademark "Johnny Doucheball" too because its going to be more and more frequently used.

Good for JFF. Buncha socialists in this thread wanting the general public to "share" in other's IP rights.

So you believe that sitting back and letting OTHERS do all the hard work and heavy lifting to build a successful "brand" then, at the end, using the power of the courts to steal the use of that brand from those who helped build it is "capitalism"?

You dumb.

Not sure why Manziel cares about the money from this lawsuit considering he owns prime real-estate in the domes of every poster on the rant.

Johnny Football is a douche.

Just link this over and over, until the idiots here figure it out.

If so you can probably fairly use and market Johnny Doucheball shirts with no problem under parody protection. Get cracking, you're gonna be rich!

Then why is he seeking damages? And why did aTm state that Manziel was entitled to all financial earnings from legal proceedings? Don't you think aTm's compliance office could handle their own shite if it was only a compliance issue?

He is trying to get paid. DWI.

It's an exercise in mental gymnastics to attempt wrapping one's head around the absurdity of this post.

But yes--to answer your rhetorical question--there's nothing wrong with sitting back while others exploit your name and likeness, and then deciding you'd like to "steal" yourself back.

This is especially true when you own a trademark in the thing you're stealing back.

Sorry, still doesn't require Manziel's 'enterprise' to file suit looking for money. That is a lame move, and everybody else on here thinks the same way except some of you ags. It's no big deal, it doesn't affect you ag fans personally so cut out the white knighting for Manziel and his white collar family. I like JF, and honestly wish I had his life for a month or three. But this is a douche move.

I think this is why the Ed O'Bannon lawsuit exists against the NCAA. I hope Aggies support this effort to bring equal compensation to all athletes as much as they support JDB's efforts

I've seen a total of ONE non-Ag post here that has any inkling of knowledge about IP law and why this suit is required, that's why "everybody else" thinks that way. Go do some googling and read up on trademark law or you're just proving to be petty and jealous.

Johnny frickin' Football is better at football than any of your players AND smarter than the large majority of your student body. Deal with it.

the IP should belong to the guy that came up with it. that douchebag and his family stole the IP of another person and threw a trademark on it. how classy

i'm gonna trademark Johnny Douchebag and i guarantee i'll end up making more money off that than anything else.
