Doesn't change the fact that, as it has been explained in here, the crime was not that severe. If he just stood up and started jacking off in a room full of people that's another story.

Maybe its not that severe but it does show how severely bad his judgement abilities are.
If Sumlin wasn't on the hot seat he might be willing to risk keeping Merritt but there is no way in hell he can currently risk keeping somebody around who is such a massive liability off the field.

I just find it highly suspect he whipped his dick out to two tutors within 24 hours, but there has never been any indication of this sort of thing with merritt before or since.
I mean we all have big dick days, but you don't just start flopping it out on a whim.

His defense was he had jock itch, not that he didn't expose himself. This happened with two different tutors who likely work with athletes all the time and wouldn't have a reason to target a random transfer on the football team. Sorry but it seems pretty open and shut considering Sumlin kicked him to the curb.
