1) that crime isn't that serious. People taking a piss on the side of the road have on occasion been charged with this in lieu of public nudity etc.
2) the "intent" element is extremely hard to prove in this crime. Since it does not appear he was intoxicated at the time, which always looks bad, I suspect they will have a hard time proving his intent.
