I am not nor have I ever defended actual forcible rape
BUT, this sounds like a situation where she got drunk & then regretted her own actions & now has "buyers remorse"

If college students get drunk and have sex, then we can't have it be that the young man is always a rapist because the girl was "incapable of giving consent"

I know that a man should stop whenever a woman says stop and I completely agree with this. If he doesn't stop, even if they were engaged in coitus, then I think he's guilty of rape in their relationship.
However, does that constitute rape that should be punished by law? In my opinion, only if the woman makes a legal case by going to the police and filing charges as soon as she can get away from him.
Waiting months, or even years in some cases, changes the circumstances legally, I think. There must be physical evidence to convict someone of a crime as heinous as rape.
