That was me that said that. Anybody interested can take a look at that thread on the Rant. As a young (debatable) atty, I enjoy these discussions.
Basically, Downing's already admitted to doing all of this so an apology would be irrelevant in the civil action. It'd matter more in a court of public opinion, which should count for something.
The thing I said about the victim's damages is that in the civil case, Downing's lawyers will not focus on whether Downing did it (he's admitted it), but rather try to pick away at the victim's actual damages. It's my opinion (though not other posters) that his damages are pretty minimal from the current facts. Not saying that his damages are $0, just that we won't be gettin' paid big $$$ like a few people think.

I just think its great this losers boss fired him. Feel bad for the baby and his wife though. Ive seen it a hundred times. People go to bourbon street and can't handle their liquor. Then think they can do what they want. Whether they mean to or not doesn't matter. Don't get hammered if u gonna be stupid
