What is this right you speak of. It is actually a violation of state compliance laws to not turn over the entire phone record. Phone records are not privileged in this case.

That is my understanding as well. For instance, the MS Trooper Association will buy equipment for state troopers. It's a non-profit that I give money to in support of those guys. That equipment that is purchased would have to be released if a public records request was made...even though private money bought it.

The money is co-mingled with a state entity and is subject to public disclosure.

Put it this way, if nothing were in those records, they'd simply release them. If it's just Hughes Hoes, they have no reason not to release them.

The records will illustrate OM continuing to cheat while under NCAA investigation.

It'll come out and Nutt's attorney will give them to the NCAA. OM is just shuffling deck chairs.

MSU doesn't need to. Ole Miss is bleeding themselves out for the long game here, costing themselves multiple recruiting classes, lots of scholarships, and who knows what else.

They could have been contrite in the beginning, fired a WR coach or something and been done.

At first I thought Nutt was just out for a senior payday -- now it looks like he doesn't GAF and is out for blood. Perhaps this builds up his media cred in some way?

And to be fair here, Ole Miss has done their best to avoid FOIA etc this whole time, the only Mississippi Media person to pursue this was "rosebowl", who we've all laughed at, yet now will be considered a great "investigative journalist".

That's one of the legacies here: Ole Miss turned "rosebowl" into a nationally known, and respected, college sports journalist. Well done black bears!

I'm ready for this to end but it might not be until October. Ole Miss fans somehow think that this COI is going to help them out and bring SA#39 down. All I want to see is SA#39 wear #39 in the egg bowl

Regardless of how and by whom payment was remitted, Freeze was using it in a capacity as an employer of a public university which is completely subject to FOIA access requests.

They're stalling.

Might want to check on past Mississippi Ethics Commission rulings on that.

I think that at the end of the day, maybe two years from now, the OM Chancellor and AD will be fired over this in addition to massive sanctions handed down by the NCAA.

I know people think it's far fetched or impossible, but if 2/3s of the SEC schools vote in favor of removal, OM can be removed from the conference.

If it comes out (actually when) that the administration was behind cheating while being investigated, burner phones, escorts, etc., don't be surprised when that is up for serious discussion.

A court can order release of the records via public records request. OM can appeal and drag out for another several months.

The records can also be had through discovery in the litigation. That could take several months and vollies of motions.

I suspect OM is trying to delay this release until after the NCAA issues their punishment. The NCAA would then either have to start over (assuming Nutt gives them this info), or ignore it and move on.

I think Ole Miss will enter into a confidential 7 figure settlement with Nutt that precludes him from either getting or releasing the information he seeks.

It will not keep Rosebowl from getting it though.

The better question is what advantage do they gain at all by stalling? They've already fired their coach (belatedly), this only drags out lawsuits and infractions.

Also, let's not dismiss the chance for a 3rd NOA to be introduced based on this. At that point, I think ole miss really would be looking at a death penalty -- though to be fair, their dragging this out has cost a lot already.

This is how the game is played. Working with the NCAA (or any other entities to which they would be accountable) isn't like dealing with your parents. You don't get any points for "coming clean" and "laying all your cards out on the table". Fans want that kind of reconciliation and closure, but that's not the way it works in the real world.

Stall. Deny. Bluff. Half-truths. Pound the table. Discredit. Throw invectives of your own. These are the gambits that we will see played out.

I have no idea if anybody is guilty of anything, but I suspect we are long way from answers that some are so desperately seeking.

Guilty of anything? OM has already admitted to multiple Level 1 violations...enough to have 60 schollies taken under the new matrix. They've fired their coach and admitted a troubling pattern in his calls.

Rosebowl has said there is more. Every time he's said that, it's been true.

They are likely hedging their bets that the NCAA will not come back.

Why did they continue to cheat while being investigated in the first place? Why didn't Bjork check Freeze's phone records earlier?

it certainly isnt about the money. Hell, they just saved 20,000,000 off of freezus fail. They are Hiding Something, and it is something BAD.
