Ok then:

quote:

Share: Cite / link: Arrest A seizure or forcible restraint; an exercise of the power to deprive a person of his or her liberty; the taking or keeping of a person in custody by legal authority, especially, in response to a criminal charge.

The purpose of an arrest is to bring the arrestee before a court or otherwise secure the administration of the law. An arrest serves the function of notifying the community that an individual has been accused of a crime and also may admonish and deter the arrested individual from committing other crimes. Arrests can be made on both criminal charges and civil charges, although civil arrest is a drastic measure that is not looked upon with favor by the courts. The federal Constitution imposes limits on both civil and criminal arrests.

An arrest may occur (1) by the touching or putting hands on the arrestee; (2) by any act that indicates an intention to take the arrestee into custody and that subjects the arrestee to the actual control and will of the person making the arrest; or (3) by the consent of the person to be arrested. There is no arrest where there is no restraint, and the restraint must be under real or pretended legal authority. However, the detention of a person need not be accompanied by formal words of arrest or a station house booking to constitute an arrest.

So detention doesn't matter...

quote:

Investigatory stops or detentions must be limited and temporary, lasting no longer than necessary to carry out the purpose of the stop or detention. An investigatory stop that lasts too long turns into a de facto arrest that must comply with the warrant requirements of the Fourth Amendment. But no bright line exists for determining when an investigatory stop becomes a de facto arrest, as courts are reluctant to hamstring the flexibility and discretion of police officers by placing artificial time limitations on the fluid and dynamic nature of their investigations. Rather, the test is whether the detention is temporary and whether the police acted with reasonable dispatch to quickly confirm or dispel the suspicions that initially induced the investigative detention.

Nor does length of time or purpose....

Got it.

I am certainly not an expert on drugs, but doesn't weed stay in your system for around a month? He had probably been smoking some of the stash he was caught with and it would show up as positive

Longer, if you're a regular smoker.

If you only smoke once it can be out of your piss in less than 5 days. You have to smoke fairly regular for it to stay a month.

Ricky Parks is obviously too dumb to realize he was given at least two chances that we know about and maybe more that we don't know about
Ricky Parks is a fricking idiot, literally.

He failed 3 drug tests at Auburn the first time around under Gene Chizik (he didn't play so nobody really knew he had failed them - until he was kicked off the team). Gus Malzahn decided to give him another chance since he stayed clean at Junior College and wanted so bad to get back to Auburn, then he went and fricked it up with bad grades and more pot.

He was also a walk-on.

I also laugh at the idea that Auburn wont drug test players if they have reason to believe they are dirty.

Failed drug test obviously are not announced publicly, but I am pretty sure Josh Dollard was kicked off Auburn's basketball team a few years ago for failing 3 drug test, which is the magic number to get the boot at Auburn. He was the best or one of Auburn's best basketball players at the time

I also believe Micheal Dyer decided to follow Malzahn to Arkansas State a few years ago because he had failed two drug test and was looking at being suspended for 5 or 6 games, which is Auburn's policy for two failed drug test. Dyer was obviously the MVP of Auburn's national championship game against Oregon

So let me get this straight... If he's caught with 8-9 grams of weed, cited & fined $1000 in Ga & returns to Auburn & fails an AD administered drug test (there's grounds to test him since he's been cited for possession) is that 1 chance or 2? Edumacate me please...

Or will he even be tested?? My guess is no...

Depending on how much time transpires between the citation and the failed test, it would likely be considered 1 event (If common sense were applied), unless enough time had passed to be confident Marijuana had been used after the initial citation.

If any person is caught with pot, I would say there is a pretty good chance they have been smoking it. I doubt any school would count the arrest as one strike, immediately drug test a player, and count a failed test as a second strike. Pretty much giving them two strikes over the same incident in my opinion

I bet Gus is happy he'll be the 1st one outta the gate Monday morning at 11:30....

Kinda sucks that all the questions & spotlight will be about the legal & roster status of your QB (& Mincey to a lesser extent)instead of being able to talk about the success of last season & expectations for the upcoming season & where he wants to be in December. Gonna be all about deflection & defending the "family" instead of optimism & expectations for '14...

Oh Well...

Yeah, looks like the AU players are going to be too distracted to win media days. Tough way to start the season. Probably another media days championship for USCe.

That is not what Michael Dyer the offensive MVP of Auburn's 2010 BCS national championship said.
