Stupid, I did know him and he knew I would kick him in the nuts if he tried to do that near me.

It seems pretty stupid to me. Look at it this way. There is now video evidence of this particular dudes stupidity. He may end up being famous for a very inappropriate reason. If he does end up getting busted then he got what he deserved. He assumed the risk all on his own when he exposed himself in public.
There was a dude that got a sexual charge for peeing on a golf course. A woman saw him, said her kids were around and he went to jail for a bit. Hey, take the risk if you want but be ready to pay the piper. He was probably drunk though so many in this thread will say it's OK.
