probably. I'm sure they filed in federal court because it was involving two parties from different states and the amount of damages claimed was greater than $75k. It was dismissed without prejudice, so they can just refile it in I would assume a Mississippi Court

He'll file it in Mississippi state court. It's far from over, but I'd still have to view this as a win for Ole Miss. I would imagine Marrs asked for that apology and the $500K donation so he wouldn't have to risk going state court. Trying to sue a university in their state would be an uphill battle.

this isn't a defamation case... it is a matter of the disparagement clause in his contract... so this falls under contract law. financial damages will not have to be presented as evidence to get a W... to determine the amount yeah that could have a factor... but actually winning the court case... financial damages do not have to be proven.

i'm just making this up i have no idea though

He will have to file in Hinds County. Good luck...worst judges in country. Ole Miss wins this battle. So, Nutt's supposed badass attorney made the same mistake a first year lawyer would have made? Very "Nutt" like...

One of those details better be a real life non disparagement clause in black and white or the next one will get quickly dismissed too. But yeah, you weirdos keep holding on to the idea that OM bought hookers for recruits. The only case that matters to us will be heard in September. The rest of that is for the Days of Our Lives watchers.

Not necessarily a bad mistake. If this gets to a jury in Hinds, most likely the jurors will be more closely tied to Jackson State, Alcorn, and Valley. They will not necessarily be predisposed toward Ole Miss. That may work in Nutt's favor.

It will be a jury of Mississippi taxpayers. They won't want a carpetbagger to take Mississippi tax money.

Especially when the show LSU taking a knee in the 3rd quarter against Nutt's team.

I thought this Mars fellow was a cracker-jack lawyer? I guess he took the cracker jack boxes when he was booted from the Wal marks.

This was discussed on local radio today. I'm not an attorney but they said this actually played into the hands of Mars and something about getting Bjork on record before filing in new court. I need to find that audio as it was local and everything now has a podcast.
