In some states adultery is a crime and parties can be sued for alienation of affections if their conduct harms the marital relationship.

Not sure about Arkansas law but many states have a ceiling on the amount they can be sued for, kinda like fighting city hall.

Both The state & the indivual would be sued

These laws would only apply to state schools not privates like Miami or Tulane

For most of American history, sovereign immunity almost universally protected federal and state governments and their employees from being sued without their consent.

Starting in the mid-1900s, however, a trend toward government accountability began to erode sovereign immunity.

In 1946, the federal government passed the Federal Tort Claims Act (28 U.S.C. §2674), waiving immunity to suit and liability for some actions.

Many state legislatures followed by enacting statutes to define the limits of immunity for state governmental entities and employees.

Title VII has an explicit waiver making it applicable to state and municipal government employers with more than 15 employees. Can't get punitive damages against a state entity. Can get punitive damages against state employees in limited circumstances if they willfully violate your civil rights while acting under color of law.
Used by minorities but also applies to equal protection claims made by women.

Title VII has $300,000 cap which does not include attorney fees or backpay and benefits which are equitable in nature.

He is likely being investigated to see if he was complicit in any cover-up or was misled by the coach. He also reports to state law enforcement supervision and will likely be removed if found to be complicit or negligent in his reporting of the facts surrounding this accident. Difficult position to be in, trusted insider who can't embarass coach but will be scapegoated if embarassing information leaks.

Thank you, the state can be sued but there is a cap

It will not cost them millons as infered by those throwing salt in the Arkansas wound.

The University is not 100% immune as the Petrino apologists implied
