The reality is, Malzahn may not leave Arkansas State. He may not turn his back on the one school that wasn’t scared off by some lunatic with an agenda and an ability to splice video.


I'm not so sure a guy like Gustav Malzahn would leave Arky State hanging.

Neither her fiancee nor the other applicants have meritorious claims against the UA. Dorrell may have a claim if she loses her job and Petrino does not.

You don't think that other. possible more qualified applicants may have a claim that they suffered sexual discrimination?

I'd be interested in hearing your reasons why you dismiss the possibility so casually.

Petrino deserves to be fired, but Arkansas fans (as shitty and annoying as they can be at times) do NOT deserve this. Sucks for them.

this. i feel for their fans. they had the best program they've had in thirty years. to have it ripped out from them like this is gut-wrenching.

Because I have litigated sexual harassment cases. This case is more valuable because of the publicity than because some nebulous legal standard was arguably violated. Have you ever seen Gloria Allred get a verdict? No, but she gets huge paydays for her clients because of the negative publicity of all her press conferences, et. cet.

Petrino fricking his fiancee may have caused embarassment to him but that is not a hostile work environment. Juries are far more sympathetic than federal judges. Unless Petrino taunts him in the hall, after being told not to by the Athletic Director, that is not a hostile work environment.

Many courts have ruled that there is no gender discrimination claim when a decisionmaker favors an employee who he is having sexual relations with in a promotion or hiring decision, finding that the decision is not based on the gender of the applicant but is based on the fondness bosses have for getting their nob polished. Just because a decision involves sex does not mean it makes an employer liable.

In many states the fiancee would have a claim against BP but not the UA.

What collegiate competition does Arkie even have in that shitty state? It's worse than LSU dancing around in ULALA's face. intentional infliction of emotional disstress is damn hard to get, but i wonder with the publicity of this thing if he could get a settlement?
