1.) Precedent was set by NCAA last year with Manziel
2.) NCAA wouldn't touch this bear if they could given all the litigation surrounding them regarding player compensation and profiting off of their own name/likeness

This isn't statism. Gurley or Manziel or whomever are not legally forced to play football and abide by NCAA rules.
