It's a weird story. He called the cops on himself after he hit a car. Which was responsible. Blew a zero, but failed field tests. He was either high as a kite or really hit his head or both. Without blood results, though, any competent lawyer could have gotten him off.

He called the police, but after he left the scene, correct?
They also found he hit a second car, I believe.

this is true. a field sobriety test gives probable cause to make an arrest but generally cannot, by itself, give rise to a conviction for DUI

I don't understand why the cops wouldn't have drawn blood. If he failed the field test, a warrant for a blood sample would have been a given. Given that he blew a 0.0, how else were the cops planning to make their case?

Without having been in court to hear arguments, I assume that he argued that he was out of it from the injury when he drove off, and then called the cops when he started coming around.

my guess is they just didn't bother with the leaving the scene charge after the DUI was dropped, wasn't worth their time anymore to prosecute that

They'd have drawn blood and the tests would have very likely shown what a breathalyzer couldn't.
Not getting transported to the hospital was the absolute best thing that happened to him that entire night.
If I'm a cop and someone calls me to the scene of an accident with someone who tells me they hit their head on a steering wheel and is obviously slurring words my first instinct would be to get the guy checked out by a doctor. Seems to me that would be standard procedure for anyone that hits their head in an accident regardless if you think they are drunk or high.

Total bs. I live in bama and know a woman who was arrested and found guilty of DUI for sleeping in her car in a parking lot. Key in ignition but car wasnt cranked . No test of any sort was administered.

I'd say most cops, in my experience, wouldn't give a shite about your head unless their was blood or you were unconscious.

like I said above, the DA likely just chose not to prosecute the case once the DUI was off the table
