Geno Smith gets his 2nd DUI, and he probably not gone.

Not saying it's right, but possession of alcohol isn't illegal, just driving when you've had too much. Pot, on the other hand, is illegal in any circumstance, in Alabama.

Edit - 2nd degree mary jane is a misdemeanor, but it probably indicates that he's been popped for that before.

A 2nd DUI is jail time in Alabama. 1 year no license. Rehab. Few grand in fines. One more DUI and he will be locked away for years. Life threatening crime vs a misdemeanor pot charge?

Please. Geno Smith should be kicked to the curb. Tyren Jones should probably be allowed back on the team.

TBF, if Smith was in another state, say Tennessee, and got busted for his second DUI, he'd have to spend a minimum of a month and a half in jail, and it could go up to a full year. In Georgia, a second DUI can be a felony offense with up to a year in jail as well.

Second DUIs are handled pretty severely in several states. Luckily, Geno was in one that seems more lax on the matter (only 48 hrs jail time, lose license for a year, & fined).

Do you know Smith was convicted of DUI the first time? I'd guess it was probably a youthful offender deal. And obviously he hasn't been convicted for this incident, so let's not call for jail time just yet.

Again, IF he actually damaged private property like was said, most judges won't grant them YO deals.

I just gave you the law for each state. No need to go all sjw on here.

If he is convicted (assuming the arrest was legal and he tested above a legal BAC), that YO deal won't mean shite to the DA/judge. Having two DUI incidents this close together will certainly land him a harsh sentence.
