No, you wouldn't. There would still be crooked cops, prosecutors and judges who conceal evidence and fix trials just like there are now. And juries don't have the first clue about burden of proof. Some will hang a defendant on practically no evidence, while others will let a guy walk no matter how much proof the state offers. The only way to eliminate the risk of executing an innocent is to eliminate executions, period.

Eye witnesses are at best unreliable in the search for the truth. It depends on the circumstances and what the witness is testifying about, but at the very least, the majority of eyewitness testimony is false.

It's going to be interesting to see how this plays out. Part of the A.M.E church's doctrine is its staunch opposition to the death penalty. Every person who died was a member of the AME church and they have already spoken words of forgiveness. Prosecutors have to consult with victims prior to seeking the death penalty. I'm pretty certain that I know what the victim's wishes will be. Curious to see if the State will honor them.

On a side note, as a good Episcopalian and defense attorney, I am also opposed to the death penalty. It is expensive, immoral and not a deterrent.

On another note... the problem with using lethal injection is the drugs are getting hard for the states to acquire.

I dont see why they cant use standard anesthesia. I recently had back surgery and joked with the anesthetist about what it cost for him to put me to sleep. His reply was he would put me to sleep for free, but he would charge BCBS to wake me back up.

Just give the condemned a small shot of morphine to put them asleep and then a large dose to shutdown everything. Guy is dead, and it was peaceful. That makes it easier for the regular citizens to accept.

(I on the other hand think we should just lock them in a cell and leave them there. No food or water. Toss the body in the garbage in a week or so. No cost of a bullet or electricity or drugs.)
