Question about a 3 car collision - Who is at fault?

If vehicle 1 strikes vehicle 2, and that causes vehicle 2 to strike vehicle 3, then who is responsible for the damages to vehicle 3?

I was just involved in a car accident and am vehicle 2 in this situation. Traffic was slowing quickly. A Dodge Ram rear ended me which forced me into a Chevy Malibu in front of me. Both my front and rear bumpers are destroyed. My lift gate won't open. My head hurts from slamming into the head rest, which is also out of alignment and my seat is loose. I've filed an insurance claim already and have plenty of pictures along with everyone's information. Can anyone give me an idea of what to expect from the insurance companies? The police would not come to the scene since no one needed an ambulance or a tow truck.

In texas i was vehicle 3, vehicle 1 paid to touch up my bumper.

Thank you for the peace of mind. My car looks like people took metal bats to it on both ends. One less thing for me to stress about.

In almost every situation Vehicle 1 is liable to both vehicle 2 and 3.

Especially if you have a police report placing vehicle 1 at fault

Sadly the police wouldn't come out. They said if no one needed an ambulance or a tow truck that we needed to take it up with the insurance company.

The police refused to come out? Wow. I've never heard that before. In my experience, insurance companies use the police report to assign fault. Without that, you might be fricked.

What piece of shite town do you live in that police wouldn't come out to a car wreck scene? I honestly thought that was one of law enforcement's jobs. Probably wrong but still, that's bad and officers should always report to a scene where someone could be injured and vehicles could be blocking traffic.

Was the wreck on private property? If not, I can't imagine no police involvement. (I hope you obtained names of witnesses)
BIG QUESTION: Does vehicle #1 driver have insurance?...and what type. If they did, then your insurance company should be able to work with the other company to get your car repaired on their dime. If they didn't, I hope you carry uninsured motorist insurance on your policy...you'll most likely need it. If you pursue a claim for injuries, you need to get a lawyer NOW!.....good luck with all of it.

Vehicle 1

Vehicle 2 has no responsibility here since it was the actions of vehicle 1 that caused vehicle 2 to damage vehicle 3.

It was on the freeway. Cops have better things to do I guess.

No witnesses stopped.

They do have insurance. I've filed a claim with both my insurance and theirs. This morning I was informed the guy who hit me attempted to file a claim with my insurance. My adjuster told him we are not accepting fault.

Other than a minor headache, I don't have any injuries. And I'm also getting over some sinus problems, so I think it might just be from that.

That's the biggie! Your insurance company should take it from there. I don't think that there is a reasonable scenario that legally would put you at fault.

This morning I found out he tried to open a claim with my insurance. He claims that driver 1 slammed on the brakes which caused me to slam on my brakes and there was nothing he could do to avoid the accident. Which is funny, because his truck was the only vehicle that had screeching tires. Dude just wasn't paying attention. And now he is trying to divert the blame. My insurance said we are not accepting fault though, so that's good. Just gotta wait and see now.

Wife was car 3 two weeks ago.. The police charged car 1 and in the report assigned blame to them. We got car 1's insurance and everything is being taken car of.

You should go see a doc though. Get an x-ray asap. If something is wrong, and you wait, you won't get paid.

I don't have any back or neck pain, and after a day has passed I think my headache was more sinus related than the accident itself. I've been sick the last week. But in statements given to both insurance companies I made sure to mention my headache.

Sure you do. You need to go to Morgan and Morgan to confirm it, but trust me. You have back and neck pain, shoulder pain, all kinds of pain. And suffering.

My mom and I were driving to dirty Myrtle when something similar happened. Car 1, my B-i-L and sis were driving in his truck pulling a camper. Car 2, my mom and I were in her van also pulling a camper. We were behind car 1 keeping a safe distance. All of a sudden car 3 cuts us off merging between the two cars as car 1 was braking. Because we no longer had the distance we intended to leave between us and the car in front of us, we collided with car 3 and pushed them into car 1. We were deemed at fault regardless of the recklessness of the car that cut us off.

Side note: were there skidmarks? We found out that day that if your brakes lock up leaving skidmarks on the road and then you collide with a car then that is considered, somehow, a vehicle malfunction and the driver of the malfunctioning car is always at fault.

We pulled off the road about 100 meters away from the accident. I never went back to check for skid marks. Probably should have done that. The guys brakes locked up and tires screeched. I am near positive he was distracted by something and just hit the brakes too late.

It just annoys me the guy would file a claim against my insurance. He won't get a dime from them. But it just shows how dishonest people are.
