Others have already answered but I will re-iterate due to personal experience.
I had a case exactly like this back in April when I was on Jury duty and was put on the grand jury. Depending on what the prosecutor decides to charge her with (IMO, he should go for the worst charge that he can) she will be spending the next 20-40 years of her life in a concrete box; she should however, never see freedom again.
My thoughts are with you and the wife/children he left behind.

Wow. Prayers sent. Not too long ago in Oxford, two drunk older side of middle aged men were driving a golf cart late at night, without headlights( 
) there was a seventeen year old boy, not under influence and driving. He did not see them and ended up taking one of their lives. Death is an awful thing and that boy will have to live with the fact that he killed someone for the rest of his life. I do not think that it was his fault. Obviously in this case, it was not your brother in laws fault. I hope that woman realizes her faults and gets penalized.
