So one of my buddies from high school lives there in JC and is a comedian, also black. He posts this story on his FB page and of course and justifiably so people are pissed.
I pointed out that this act should give him some awesome material on stage and posited this query...
If he comes out dressed as Col. Sanders with a bucket of KFC, do you think the reaction would be the same?
His answer in true comedic fashion: "Dude, who doesn't want free chicken?"

Not sure how intimidating a white guy in a gorilla mask is in Tennessee?

It is provocation, however. What is and is not provocation is obviously up for a judge to decide, but this would fit right in there with the ''fightin' words'' laws.
I'm a free speech absolutist in many respects, and often say it's the only thing I'm a radical over -- but there are consequences to poking at sensitive topics physically (being within the same vicinity).
That being said, he absolutely did not infringe on anyone's civil liberties.

I guess he has a right to be a racist jackass, but if something bad happened to the guy, I wouldn't be sad about it, and I doubt if I'm alone.

At the risk of defending a racist wearing a gorilla mask - it doesn't seem like there was any evidence he was there to injure, threaten, or coerce. More like he was there to make an arse of himself.
That is a legal right that accompanies free speech.
Just don't be surprised if one of the people you set out to troll jams said mask and banana up your backside.
