ETA - Now that I've clicked the link, while I hate everything about BLM, they'd have been pretty justified if they'd whipped his arse.

He's now been charged with civil rights intimidation, which can be a class D felony or class A misdemeanor

I didn't watch the video but I'm assuming he didn't threaten anyone or destroy anything. Charge is bogus and he should counter with malicious prosecution if Tennessee allows it. It's not illegal to be a racist prick.

Wearing a mask with intent to injure, threaten, or coerce another is an A misdemeanor.
Actually threatening or injuring another is a D felony.
If he does get tried it'll be under the misdemeanor portion of the statute.

Seems kind of bullshite IMO. If you want to go out in a gorilla mask and hand out bananas you should be allowed to (of course taking the risk of getting your arse kicked)
I think he has a solid argument that handing out bananas isn't injuring, threatening or coercing

I imagine his defense attorney would be arguing that there was no intent to "intimidate".

The full story adds more context. The "rally" appeared to be just a handful of folks standing around with signs. No blocking traffic or getting free stuff from a Wal-Mart. Oddly for a BLM rally, it looked like an actual, legitimate, legal expression of free speech.
Gorilla-boy shows up and isn't legitimately counter-protesting in a similar fashion. He appears to be actually engaging the BLM people and trying to hand them bananas.
You can make a pretty strong argument that he's attempting to intimidate. At any rate, it was an a-hole move (albeit one that made me laugh out loud) that could have caused trouble where there would have otherwise been none.
