Flecia C. Adams is the reason for this. Jackson State grad. She will indict for any reason at all for a hate crime.

A year after all the 50th anniverasry events on campus for James Meredith, a student hangs a noose around the statue with a rebel flag and you guys want to pretend that it's not a big deal?

Agreed. Also, I live and work in NC. I can't stand when shite like this hits the news, and reinforces all of the dumbass stereotypes people up here already have of us. I really am amazed at the level of ignorance I'm met with up here when I tell people I went to Ole Miss (think hurrr durrr illiteracy/obesity/racism type comments). But I really can't blame them for their uninformed views, when the PR we get here is for shite like this.

A grand jury will indict a ham sandwich. There really is no need (or much basis) for a federal civil rights case here. It only brings unwanted new attention to this and does nothing to help the University. Didn't these degenerates get kicked out? That and a hefty state court fine should be enough.
Let's flip this: if some non-white kids hung a sign around the soldier in the circle stating "X Color Power!" would it even garner a modicum of any law enforcement or media attention? I mean-some students' families may have fought in the University Grays-and they might find that highly offensive, if not be intimidated by it. Would this be a hate crime?
Hate crimes are a pander, anyway. Nothing more, and nothing less. Generally, and as has been slowly eroded, you have to prove intent and/or malice (mens rea) as an essential element of the crime, unless strict liability was written into the code-like statutory rape. Now, it is glossed over by many prosecutors, and ignored by defense attorneys and jurors, to the detriment of a defendant, but it is still there.
All hate crimes are based on underlying other crimes-which carry their own punishment and, as stated above, already have an intent and/or malice element. In this case, vandalism is the underlying crime, and the mens rea was obvious in the act: placing a noose on a statute of the man who integrated Ole Miss obviously had race implications.
The "hate" in a hate crime is codifying a second layer of crime based on intent and/or malice prefaced on the crime's "message" to a person or certain group of people, rather than, in this case, towards the victim (which is the University). "Hate crime" at its core is "thoughtcrime." See Orwell, George, 1984.
