his makes no sense. He paid restitution for stealing the boot in Clark county. It is ridiculous that he would get charged with a felony because he cut the boot off in Henry county. He could have thrown it away on campus and it would have been just the theft charge.

This is the problem with the law enforcement system, stacking charges.

Actually, it makes perfect sense once you read the story.

He took his entire wheel off in Clark county, put on the spare (I assume), and then drove to Henry county.

In Clark county, he's committed misdemeanor theft.

In Henry county he cuts the boot off the wheel, thus committing the crime of destroying property or whatever they called the charge.

If he cuts it off and throws it away in Clark county, he's charged with both crimes there. If he doesn't cut it at all but leaves it in Clark county, he's charged with whatever they call avoiding the parking ticket - but he isn't going to do that because it's attached to his tire and wheel. To ditch the boot without cutting it he's got to leave his tire and wheel too.

There are no stacked charges, there are two different crimes.

The rub is that he committed the two crimes in two different jurisdictions. One was a misdemeanor, and it was easily resolved in that jurisdiction. The other one is a felony, so it's going to naturally take a bit more to resolve - particularly since most of the country is WAY behind on grand juries since COVID shut them all down for a long time last year. If he made restitution in Clark county and UGA or whomever owned the boot is satisfied, the GJ will probably no-bill the case and that will be the end of it.

That should not be a felony and the DA's office should be ashamed of themselves for filing that charge. Hit him with something, sure but a felony offense for removing a boot is dumb af. This is the kind of crime we'd all be celebrating and laughing at if some crazy old eccentric white dude did it because he wanted to give the finger to the gubmint.

Demetrius Robertson had to be close to 30 years old by now.
This is the year!

The university police don’t decide whether or not to pursue prosecution. That’s entirely up to the district attorney or whatever it is called in Georgia. Also, his case in Clark county (where the university is located) has apparently been resolved. Always a good idea to direct your ire at the correct people.

I’m not going to jump in the piling on Auburn for taking a “hoodlum” transfer. Robertson really seems like a good young man. Was it a stupid thing to do? Yes. Did we ALL do stupid stuff at that age? Yes. Do many of us continue to do stupid shite throughout our lives? Also yes. Any UGA fans piling on in this thread are just doing it because it’s fun to make fun of Auburns criminal transfers. DRob is a good kid and I think most of us hope he does well this year.

We have long needed to replace the UGA PD with mall security.

They have always been your stereo typical, over aggressive cop without enough to do. Hell, and I support law enforcement over all.

Glass Houses

And More

And to be fair...Auburn has a good record with taking in young men who strayed in poorly disciplined programs and then putting them on the straight and narrow.

You may not be aware, but the DA made it very clear that those boys were not guilty of a crime due to insufficient evidence and a childhood without A/C.

Hardly the criminal activity of a serial speeder and car boot remover. I'm scared there are people like him on the streets.

Agreed, but bulldoze the fricking public housing hoods in Athens first. That's where all the crime and temptation derives from...

We know the woke fruit cakes over there wont do or admit it but its still true as the Gospel.
