You sure they weren't tried together? Wade is listed as the co-defendent in the arraignment papers from July:

They were indicted together in January.
They are/were not being tried together.
Jefferies had his own trial.

He was never convicted of the 2009 charge and that case has yet to even be brought to trial.. it's still pending... after 5 frickng years..... 5 years after they allegedly stung him at the Advance Auto on North Avenue...

Yes, I did read it. My comment was more related to the guy who said something about probable cause. The randb blotter is a little more succinct, though. Useful for us slow folks.

Driver, flight, cash-he screwed. I'd predict a guilty verdict.
I call these constructive possession cases Aerosmith's "Nobody's Fault" cases because the argument is you can't link the drugs to a specific defendant. You have to weigh various factors in determining whether there is sufficient evidence of constructive possession. LINK. They can be tough cases to prove though, so generally a defendant will have a shot at an acquittal and being tried alone helps if you are defending the case in that you want to place the blame on the person who isn't there in court.

Most states, including Georgia and Arkansas, require unanimous jury verdicts in criminal cases. LINK
When you read that linked Georgia case in my previous post you can see how difficult it can be to prove constructive possession. Proximity alone generally won't cut it (of course if someone was sitting on a bag of dope that would be different). The issue of flight to avoid police is probably the biggest thing against the defendant on trial in this case unless he can explain it away.

Not guilty, if the jury follows the law. All of the drug evidence is circumstantial. To convict under Georgia law on circumstantial evidence, said circumstantial evidence, in order to be considered, must have no reasonable explanation other than the guilt of the accused. I'm sure the defendant's lawyer has come up with a whole lot of explanations about where the dope the cops found came from, or could have come from, and none of those explanations involve his client!

The verdict was Not Guilty on all counts. 3 hour deliberation.
