You don't think anyone from the AD went with him to the hospital and advised him to opt out of disclosure? Particularly to avoid issues such as this?
Well, I don't know that, but honestly I doubt it. A friend probably drove him. I just know the act of releasing a name is not a HIPAA violation if no request is made. I mean the very act of calling a name in the lobby would be a HIPAA offense at that point.

You're not supposed to call Pt's by their full names in waiting rooms for this reason

HIPAA Privacy Rule explicitly permits the incidental disclosures
This news report is not incidental. It's an intentional leak, which is what hippa is made to prevent

However, these incidental disclosures are permitted only when the covered entity has implemented reasonable safeguards and the minimum necessary standard, where appropriate.
i.e. You should not make a practice of calling out Jane Smith instead, it should be Mrs. Smith, Smith, ect.

He was correct, as long as Dampeer did not Opt out

How will the new rules affect what information I can get from a hospital?
Among other things, the HIPAA privacy regulations prescribe the conditions under which hospitals may (and may not) release information about patients to the public--including the news media. Generally speaking, healthcare providers and other “covered entities” must get written authorization from an individual before disclosing health information.
In some instances, hospitals can still provide “Directory Information” about an individual patient without that patient’s express authorization.
Directory Information can be disclosed when:
The reporter asks for the person by name;
The patient has not restricted directory information;
The entity has provided its privacy policy to the patient, orally or in writing; and
The patient has not opted out of directory.
quote:
What is “Directory Information”?
Directory Information includes a patient’s:
Name
Location in facility; and
Condition in general terms that does not communicate specific medical information.
quote:
What if a patient has “opted out” of the Directory?
If the patient has requested that the hospital not release any information (including even that the patient is in that hospital), the hospital will not even confirm that the patient is in the hospital (and will obviously not disclose additional information).

That was in reference to the two events mentioned in the question. Regardless, answering a question is not an "intentional leak", especially if it isn't protected by HIPAA at that point. It doesn't release any sensitive or specific information about your health. Hell, the person probably didn't even know who the hell he was.
I don't know why I'm arguing this anymore. It's not opinion at this point.

Yeah, I mean it's not that complicated guys, you hear it all the time: "Where have you been, I called around to hospitals all night to see if you were there!"..
I didn't know this wasn't common knowledge.

Amazingly enough, this was reported in the puzzlingly and mysteriously titled "Duke" thread.

Also, is this not a HIPPA violation if she's naming someone from the hospital staff as her source???
Yes, but HIPPA is broken all the time in relation to the press and nothing is done. A good example are those Ebola people a while back.

Bottom line: this team is severed.
I hope the tumor has been removed. That it wasn't malignant. We have a full recovery diagnosis. If not, the medical directive: do not revive...War Basketball.

PAM has confirmed a broken Jaw. The Hospital DID NOT disclose a broken jaw, so no violation.
Second, it is HIPAA. Their are many exceptions to the rule, one of those is public health concerns (Ebola). If folks really want to learn about it, here is the link.
HHS-Goverment Ebola-HIPAA Release - Guidance
Upon request for information about a particular patient by name, a hospital or other health care facility may release limited facility directory information to acknowledge an individual is a patient at the facility and provide basic information about the patient’s condition in general terms (e.g., critical or stable, deceased, or treated and released) if the patient has not objected to or restricted the release of such information or, if the patient is incapacitated, if the disclosure is believed to be in the best interest of the patient and is consistent with any prior expressed preferences of the patient.
"The HIPAA Privacy Rule protects the privacy of patients’ health information (protected health information) but is balanced to ensure that appropriate uses and disclosures of the information still may be made when necessary to treat a patient, to protect the nation’s public health, and for other critical purposes."

You guys argue about the stupidest shite. Why would any of you argue the technical language of HIPAA on a sports board? Go do something productive.
It's another rumor. Add it to the stack that you guys contribute to every day here. This has turned into the Auburn Gossip and Bitch Board.

Dampeer may be done for the season. Broken jaw. He is a senior but he can take a redshirt if he doesn't play again this year.

MAybe it's a sign we've ran out of football related ills and woes to argue about and have moved on to nonsensical issues
