i view this as a college football forum.
i'm not an ACC anything. I don't root for conference, and i didn't attend ACC university.

penn state had two losses, and they lost to a team OSU beat. lol you conveniently overlook that.
not taking conference champions is bit of an issue in the sense that those teams did not play in an additional game and have extra time to rest players.

That is not the point
In a true playoff system you have automatic qualifiers.
Because of ND's independence and 5 Power Conferences it cannot happen unless you expand it to 8
I believe this will happen after this current system runs out. I am not sure of the year
