Most employment contracts limit or do not allow the employee to profit from their association with their employer outside of their salary. NFL players can’t use their NIL without limit. Colin Kapernick FAFO how his use of his NIL linked to the NFL was not allowable. Government employees can’t use their job to promote politicians and they can’t run for office for the most part. In an at will work state, the entire SEC and ACC nearly, there is almost no limit to what an employer can require of an employee.

Will only work if everyone agreed and there was some entity who had the authority to enforce the terms when a school inevitably decides they don’t have to play by the rules. That’s what the NCAA is doing now, exercising the authority member schools granted them.

No matter what the sign says on the door of the office of the regulator the regulated is gonna squall like a mashed kitty when the regulator regulates. Aunt Sally or NCAA makes no difference. There has to be rules and someone has to allowed to enforce them. That’s what the NCAA is doing. NCAA members volunteer to comply and be regulated. When the NCAA regulates the regulated complian.

This is the problem. Your solution is to make pay to play allowed. This is a negative for the sport. You should be hoping the courts say the NCAA's pay to play restriction (literally the ONLY restriction on NIL deals) is an allowable rule for them to put on member organizations. If the courts agree with that, CFB will do much better.

Your argument is that no regulation can be put on NIL. I'm hoping that's not true.

If that rule is illegal, then the courts would be saying that it's illegal to put any restriction on a NIL deal, even one that protects the player in the contract (allowing the player to keep the money even if they transfer is a protection for the player, not a restriction).

That would mean that there can be no regulation of NIL. The courts may not want to take that step. Their ruling so far have been about not letting the NCAA restrict players, but allowing transfers without breaking the contracts is the opposite of that. It removes a restriction as the player can then transfer without losing the NIL deal.

I do find it funny that we've now arrived at the point where UT fans have accepted that their school has engaged in pay to play. They're now simply saying that while they broke the ONLY rule for NIL, that rule is illegal so it's all good.

No, if that rule is illegal, then the courts would be saying the rule is illegal. The NCAA is welcome to place any restrictions on NIL deals that fall within accepted legal guidelines. You want the athletes to get paid? Ok, fine, but in that case, they are subject to the rules that govern employment.

The likely outcome of this eventually is that the "student athlete" myth ends, the "collective" sham is abolished, college football separates from the NCAA, and players become paid employees of the schools they play for, with all NIL deals, penalties for transferring, etc. all under one contract.

This is what everyone asked for. When people like me said the NIL would destroy college football, this is what we were talking about.

The NCAA came after us, so we have to be the ones to start the shift. Not our fault they came after us.

Doubtful. As I have noted time and time again, the courts have had no hesitancy in quickly neutering the NCAA anytime one of their rules becomes an issue.

I'm hoping it's not illegal. It's literally the only rule on NIL that exists. It's an important rule and it's good it's starting to be enforced. Taking the only restriction to NIL that exists off the books is a bad move in my opinion.

But as of now it IS the rule, it hasn't been found illegal yet and UT seems to be admitting they broke the rule.

I don’t disagree but the NCAA has a long history of selective enforcement and inconsistent penalties for various infractions.

They have outlived their usefulness
