I don't think you really understand what you are talking about. The consequence is the fine he has to pay.

Yeah I've had my car searched 3 times and never been cuffed. Probably due to the whiteness though

And yet he was given a citation. He was not arrested. You can be arrested for anything on the road (as small as not wearing a seatbelt)
