This is from Miller's lawyer's statement. How did Davis deduce from this that the statement says Miller did not realize there was a gun in the car?

Before Brandon arrived to pick up Mr. Miles, Mr. Miles and the individual with Ms. Harris apparently exchanged words. Without Brandon knowing any of this context, and as Brandon was already on the way to pick up Mr. Miles, Mr. Miles texted Brandon and asked him to bring him his firearm. Brandon subsequently arrived at the scene to pick up Mr. Miles. Brandon never got out of his vehicle or interacted with anyone in Ms. Harris' party. He was never involved in a verbal altercation with Cedric Johnson or Mr. Davis. Brandon never touched the gun, was not involved in its exchange to Mr. Davis in any way, and never knew that illegal activity involving the gun would occur.


From this statement, in fact, it's readily apparent that Miller knew the gun was in the car because it says Miller never left his car after arriving on the scene even as Miles gave Davis the gun in the back seat while telling Davis there was "one in the head."

So at the very least, Miller knew the gun was in the car during its exchange in the back seat because Miller was in the driver's seat and never got out. So even in the unlikely event that Miller did not read the text from Miles and did not know the gun was in his car before he arrived at the scene, he certainly knew it was in his car while the gun was being exchanged in the back seat in his presence.

At that moment, after the exchange, Miller still had the chance to do the right thing, ask them why they needed the gun, and when he found out, drive them far away from that scene while advising them to cool off and that deploying a gun in that situation could end badly for them. But Miller didn't do that right thing.

So maybe Miller didn't even ask them why the gun was needed. First mistake. (Unless his first mistake was knowingly bringing the gun to the scene, which his lawyer did not rule out.) And if he did ask, got the answer and did nothing, second mistake.
