One of the reasons we licensed it to Seattle ... it set a precedent that we can use to enforce the trademark against anyone else in the future. The fact that somebody pays us a licensing fee is, in and of itself, evidence of a valid and enforceable trademark.

Bottom line: We didn't want to litigate it ... this time.

We originated the phrase. We own it. They stole it. They admitted it. They pay. All is good.

Not sure if any of these ladies are lesbians or not, but they are not cheerleaders. They are members of the dance squad, much like LSU's who perform at halftime. Another aggie tradition: male cheerleaders.

Actually--unlike most schools who DO have male cheerleaders--we don't have any cheerleaders.

I can't imagine anyone sitting at his computer/phone/iPad, thinking it would be damn clever to post a "Dude! A&M has male cheerleaders!"

No.. A&M did not originate it.. University of Iowa has reference to the 12th man for a term of their student body in print almost a decade earlier. European soccer has been using that term for longer than that. A&M copyrighted it in the US, nothing more...

I would actually be more concerned that at some point A&M will be challenged over this and lose. That is why the fee is so low. It is not worth the hassle for Seattle to take A&M to court, even if the likelihood of winning is 90%+, if the cost so little. A trail would cost a ton and there is always the chance of losing. If A&M threatens to up the fee Seattle will take them to court and A&M stands a legitimate chance of losing.
