Grand jury declines to indict UK DE Tubman in rape charge

Really happy for the kid but hate that his life is forever changed by this. I don't know that he ends up back in Lexington (understandable). He's been back here in Louisville with his family while awaiting this to potentially go to trial and had to drop out of classes at UK.

I can't for the life of me understand why someone would falsely accuse someone of rape. It almost should be punishable but then you run the risk of people fearful of coming forward in true circumstances.

Not sure how they managed not to issue true bill given indictment rates but the defendant speaking would be very unusual here in TN and in most places. Usually, a Grand Jury proceeding is simply the prosecution presenting a case and the defense does not get to challenge or speak to anything. That's why the indictment rate from grand juries is so high.

At any rate, if he was really innocent I'm happy it ended for him this soon.

While obviously taken with a grain of salt, the impression I got from people who know of the situation was that her testimony was a driving force behind the charges to begin with. And that the evidence simply showed that they slept together.

I know there was some speculation that she was trying to get back at him for breaking things off with her. And I have some former coworkers that taught him at Seneca who were very, very shocked when the news came out given what they knew of him.

For the sake of justice and not having a rapist walking free, I hope that's accurate. Still unusual for him to testify. Do you know if Kentucky, at least in this case, uses and investigatory type GJ (we do every now and then and it can be different than your standard Grand Jury)?

But again, if it was all craziness I'm glad for him.

As a criminal defense attorney, it's time we rethink our broad rape shield statutes and evidentiary rules prohibiting mentioning an accuser's prior sexual conduct. These rules create an atmosphere where false allegations cannot be exposed until discovery, after the accused has been slandered and libeled for months. These allegation ruin people's lives and it happens every day.

It's so much easier to quash charges by ruining the accuser's life really early rather than waiting until trial, amirite?

It sounds like Stoops is open for Tubman to return to Lexington. I hope he decides to play for the Cats, but would understand he would want to transfer considering the situation.

Unless you're involved in Federal rape cases, there really are only a handful of actual rape shield laws and they come no where close to the Federal Law. This is why media outlets have revealed victims names on more than one occasion.

In the VAST majority of rape cases the so-called rape shield law isn't a law at all but the media's personal choice to not ID victims.

Now, I would not be opposed to shielding most defendants and the accused from their names becoming public knowledge until post-conviction. We live in a society where nothing goes away and in this case France and a few others have the right of it. BUT that runs amok of the press/1st amendment so is likely a dead cause.

From all accounts his family really likes Stoops, understood what they had to do in the situation, and his Mom would like to see him back at UK. The coaching staff has kept tabs on him and the sole reason for him leaving school was because he wasn't even allowed to step foot on campus with her there during the investigation.

Like you said though, I'd love to see him back in Lexington but I can understand if he doesn't want to be and will wish him luck wherever he goes.
