A grieving father has escaped a possible life sentence after a Texas jury found him not guilty in the murder of a drunk driver who killed his two young sons.
David Barajas, 32, broke down in tears as the verdict was read in an Angleton court on Wednesday, the New York Daily News reported.
“I am relieved but still in pain. My two boys are dead and nothing will bring them back,” he said during a news conference.
Prosecutors failed to prove Mr. Barajas killed 20-year-old Jose Banda in a fit of rage in December 2012. Banda was allegedly drunk when he ran over and killed Mr. Barajas’ 11- and 12-year-old sons, who were trying to push a broken-down vehicle off the road.
Prosecutors claimed the enraged father retrieved a gun from his home and returned to shoot Banda. Defense attorney Sam Cammack maintained that Mr. Barajas didn’t even own a gun. Gunshot residue tests taken from the father came back negative, the Daily News reported.

Good. Completely justified, in my opinion.

Pretty clear he was innocent. Not that I would blame him if he wasn't.

Too bad he's going to hell now.

I would have voted not guilty even if there had been video of him shooting Banda.
